Using Rental Income on a Departing Residence ... - Marin Real Estate

In recent months, the Bay Area's relatively low inventory of homes for sale has created a bit of a seller's market. Although sellers remain open to negotiations once in contract, they are almost universally unwilling to consider any offer that is contingent on the sale of the buyer's current home. For this reason, homeowners looking to trade up or move to a new area are left with three options: 1) sell their home and rent until a prospective new home is found, 2) Qualify for the purchase mortgage carrying both properties' housing payments or, 3) qualify with projected rental income on their current home.?

Although most buyers would prefer to have their new home lined-up before parting with their current, for many there may be no choice. If sale proceeds are needed for down payment funds, or if their income would not otherwise allow them to qualify for the new mortgage, then sell first they must. Those able to qualify carrying both their current and the new home's combined housing payments can generally move forward with the purchase (though some lenders may require assurances that they will continue to make payments on the old mortgage). Borrowers who fall into the third category generally have adequate down payment funds to satisfy the new purchase loan, but lack sufficient income to qualify with both housing payments. For these buyers, using rental income on their current home to offset housing expenses may be their best bet.

With conventional financing, buyers will need to work within the strictures of Fannie Mae guidelines, along with any additional requirements imposed by their chosen lender. In general, these are the rules that will apply:

  • They will need to verify 30% equity in their current home. (This mitigates concerns that they may be considering a "strategic default" on the old home. An AVM (Automated Valuation Module) or appraisal will be needed to prove their equity position.
  • Rental income must be documented with a fully executed lease agreement. The lease may be month-to-month.
  • The lender will require a copy of the security deposit and proof of deposit.
  • Rental income from a family member or an individual with an established relationship to the borrower is not allowed.
  • 75% of the verified rental income can be used to offset housing expenses.

Perhaps the biggest obstacle in operating with this strategy is in lining-up a prospective renter who is happy to wait until you have entered into contract on a new home. But if you want the best terms on 30-year fixed money, it's the game you'll have to play. There are, however, other good options, such as 5 and 7-year ARM products that will allow for a rental offset based only on a rental survey to determine fair market rent. In this example, you will still need at least 20% down payment funds and the established rental income will be discounted to 75%, but you won't need to provide lease agreement.

?Finally, there is another good option for buyers with limited down payment funds who may have little or no equity in their homes. FHA loans provide financing as high as $729,750 on great 30-year fixed money with down payment funds as low as 3.5% of the purchase price. And for those whose equity has eroded and who may even be upside down on their current home, the FHA requires just 25% equity in the departing home and will base this figure off of the original purchase price!! But the borrower will still need to provide an executed lease agreement and proof of deposit for security money.

Dempster shuts down Red Sox

BOSTON (AP) - That's the Ryan Dempster the Texas Rangers hoped they got at the trade deadline.

Dempster rebounded from a rough debut with Texas by pitching shutout ball into the seventh inning, Ian Kinsler had a pair of RBI singles and the Rangers snapped a two-game losing streak with a 6-3 win over the Boston Red Sox on Tuesday night.

"Anytime you have a rough one you want to get out there the next day," Dempster said. "Those five days take a long time. I think just knowing the lineup a little bit facing these guys. I was able to use the fastball and had a good split."

Dempster (1-0) allowed three unearned runs, six hits, struck out six and walked one in 6 2-3 innings.

Acquired from the Chicago Cubs minutes before last week's non-waiver trade deadline, he was tagged for eight runs in 4 2-3 innings by the Angels in his first Rangers' start on Thursday.

On Tuesday, he showed why he was the one of the top prizes at the deadline.

"Even though he gave up all those runs against Anaheim, he kept us in that ballgame and we won that ballgame," Rangers manager Ron Washington said. "He had a two-point-something ERA, leading the National League in ERA, leading the National League in (batting average) against. We know he's capable of getting outs, and he proved that tonight, without a shadow of a doubt. We're very happy to have him. We certainly need his leadership in the front part of our rotation."

Rangers outfielder David Murphy knew how Dempster felt, having been dealt by Boston to the Rangers at the deadline in 2007.

"He's a veteran and he's an easygoing guy to begin with, but I think as a man you want to earn your keep," he said. "Obviously after not having his best stuff his first outing, he wanted to turn that around as quickly as possible. I think he did that tonight."

Josh Hamilton and Nelson Cruz each had two hits and drove in a run for Texas.

Will Middlebrooks had a pinch-hit three-run homer for the Red Sox, who have lost five of seven.

The AL West-leading Rangers have lost three straight only three times this season.

Jon Lester (5-10) gave up four runs on six hits in 6 2-3 innings. He's 0-5 in his last six starts.

"It's another heck of a performance. We didn't score the runs and he didn't get the breaks," Red Sox manager Bobby Valentine said. "Couple of curveballs to a couple of left-handers wound up hurting him."

Lester, expected to be one of the club's top starters, hasn't won since June 27.

"I can't keep talking about being frustrated and all this stuff," he said. "Everybody obviously knows here that we're frustrated and we don't like losing. ... But there's positives for me personally in this game that I'm going to take and go forward to the next one."

Boston's Dustin Pedroia was called out on an attempted check swing by first base umpire Paul Nauert in the eighth and ejected in the top of the ninth.

"It looked like he checked his swing from our vantage point," said Valentine, who came out after his second baseman was tossed.

Until Middlebrooks belted his homer, it was very similar to when Dempster faced the Red Sox earlier this season.

He mixed a sharp splitter with a well-spotted fastball to keep Boston's hitters off-balance.

Joe Nathan worked the ninth for his 22nd save.

With Texas leading 4-0 and two outs in the seventh, Kinsler misplayed Ryan Kalish's grounder for an error. Middlebrooks followed by hitting the first pitch over the Green Monster - where a fan reached out to grab the ball near the top of the wall. The call was reviewed and upheld after a lengthy review.

Cruz's RBI single made it 5-3 in the eighth. Hamilton's single made it 6-3 in the ninth.

Dempster worked seven shutout innings against Boston in Chicago's win on June 15.

The Rangers broke a scoreless tie with a pair of runs in the sixth. After taking a close pitch for a ball with a 1-2 count, Murphy had a leadoff double. One out later, Kinsler singled off the top of the left-field wall, advanced on a groundout and scored on Hamilton's single to right.

In the seventh, Murphy had a sacrifice fly and Kinsler added an RBI single, making it 4-0.

Carl Crawford doubled in the first, but was picked off second. Cody Ross opened the second with a double, but was stranded.

Dempster then retired 14 of the next 15 - allowing only Ross' two-out double in the fourth - until he walked Pedroia in the sixth.

The Red Sox were coming off an eight-double game in Monday's win and three of the first four balls they hit into play Tuesday night were off the Monster, including two doubles.

Defense: Pastor thought mom OK to leave US

(AP) ? A Mennonite pastor worked with a number of other people to help a woman flee the country with her 7-year-old daughter rather than share custody with her former lesbian partner in Vermont, federal prosecutors said.

The 46-year-old pastor from Stuarts Draft, Va., is on trial on a federal charge of aiding and abetting in international kidnapping. Opening statements began Wednesday; the trial is to continue into next week.

Kenneth Miller is accused of helping the woman elude a Vermont court order to share custody with her former partner, and flee to Nicaragua to live with Mennonites there. The current whereabouts of the mother and her now 10-year-old daughter are unknown.

"We are here because others, including the defendant, Kenneth Miller, aided in her cause," Assistant U.S. Attorney Eugenia Cowles told the jury.

Miller's lawyer, Joshua Autry, said he will prove his client believed the mother had full custody of her daughter and could travel freely.

"Kenneth Miller thought that she was the full legal guardian," Autry said in opening statements.

Lisa Miller, no relation to the defendant, and Janet Jenkins of Fair Haven entered a civil union in Vermont in 2000. Lisa Miller gave birth to her daughter, Isabella, in 2002. The couple later broke up, and Lisa Miller returned to her native Virginia.

A custody battle ensued, and a Vermont judge transferred custody of the girl from her mother to Jenkins after the court says Lisa Miller refused to cooperate with visitation arrangements.

Prosecutors told the jury Wednesday that on Sept. 22, 2009, Kenneth Miller drove the mother and daughter from Virginia to Buffalo, N.Y., where the two crossed the Rainbow Bridge into Canada and flew to Central America and lived among Mennonites.

"In the dark of the night, Lisa Miller took her daughter across that bridge," Cowles said. "Lisa Miller didn't act alone."

Among the first witnesses, Ontario Mennonite pastor Ervin Horst said he picked up Lisa Miller and Isabella on the Canadian side of Niagara Falls after the two crossed into Canada by taxi. Horst said he was in regular telephone contact with Kenneth Miller and declined to cross into the U.S. to pick up the mother and child because he didn't want to cross an international border with them. He said he took them to the airport in Toronto the next day.

When asked if he knew about the custody case, he said he didn't know the details.

"Lisa did not feel good about what was happening and wanted to protect her daughter," he testified.

UN, World Bank Unveil Carbon Finance Program for Philippines Pig ...

A UN and World Bank initiative has begun providing pig farms with incentives for using Earth-friendly waste treatment facilities.

On July 26, the United Nations Framework Convention on Climate Change registered a Programme of Activity for piggeries under the Methane Recovery from Waste Management Project, which allows farms across the Philippines to generate carbon credits. Implemented by the Land Bank of the Philippines and supported by the World Bank?s Carbon Finance Unit, the project provides an additional income stream in the form of carbon finance to operators of piggeries to encourage them to install proper waste management systems and reduce the emission of methane, a potent greenhouse gas. The Spanish Carbon Fund, administered by the World Bank, is buying the piggeries? carbon credits.

Under the program the pig farmers earn carbon credits for each ton of methane captured. When fully implemented, the program is expected to produce over 100,000 tons of carbon credits per year from dozens of pig farms across the country.

This is the first program of activities from the Philippines to be registered and it is the first registered biogas PoA in the animal waste sector in south-east Asia, a region home to a significant number of the world?s pigs, the Wold Bank said.

Carbon finance facilitates financial rewards through carbon credits for the reduction of greenhouse gas emissions by emitters in developing countries, like the Philippines, through the Clean Development Mechanism of the Kyoto Protocol.

The CDM allows industrialized countries and companies to fulfill some of their greenhouse gas reduction commitments through the purchase of carbon credits in clean-and-green projects in developing countries, according to the World Bank.

In September 2011, Google invested in a pilot project by Duke University and Duke Energy that, similar to the Philippines program, converts waste from a pig farm into usable energy that can then be sold for carbon-offset credits. By capturing greenhouse gases from hog waste and burning them to run a turbine, the system produces enough electricity to power 35 homes for a year.

At the time the story broke, the two Dukes had spent $1.2m on the system so far. Google has not disclosed the size of its investment.
